The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the named accused persons including the petitioner took Rs. 5 lakh on different dates from him on the pretext of providing service in the Railway and thereafter gave a forged and a fabricated joining letter of Group-D in Railway and the same was found forged and fabricated and when the informant demanded his money
Patna High Court CR. MISC. No.19075 of 2022(2) dt.27-09-2022 2/3 from the accused persons he did not returned, as such it is alleged that the petitioner committed forgery and cheating with the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case and if what has been alleged by the informant in the FIR is true then the informant is equally liable for prosecution as he himself admits that he had given money to seek backdoor appointment in the Railway based on bribe, the learned counsel for the petitioner next submits that the police after investigation submitted final form but the learned trial court differing with the police report took cognizance of the offence in a mechanical manner. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like
