The petitioner seeks regular bail in connection with Siwan Rail P.S. Case No. 70 of 2017 instituted for the offences under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that while he was travelling in a train the Police had raided and recovered 69.750 litres of illicit foreign liquor from beneath the seat of the Railway compartment. The petitioner was apprehended from the spot. The learned counsel for the petitioner submits that no recovery has been made from the person of the petitioner and in fact he like others was also a co-passenger and recovery if any

Patna High Court Cr.Misc. No.63306 of 2017 (2) dt.17-01-2018 2/2 cannot be attributed to him. The petitioner has a clean antecedent and he is in custody since 08.08.2017.

Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner is having a clean antecedent, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge, Siwan in connection with Siwan Rail P.S. Case No. 70 of 2017.
