The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/307/427/452/326/379/506 of the Indian Penal Code.
There is general and omnibus allegation of commission of assault to the informant against all the petitioners. Petitioner
Patna High Court CR. MISC. No.19316 of 2019(2) dt.29-03-2019 2/2 Bajrangi Prasad allegedly poured hot oil on the body of the informant. The injury report, at Annexure-p/3, would reveal that no burn injury was noticed by the doctor; rather two simple injury, caused by hard and blunt object, was found. One was at the left parietal reason.
Submission is that the allegation is not specific and the petitioners have got no criminal antecedent.
Considering the aforesaid fact, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Buxar (Town) Police Station Case No.512 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
