To hold and declare that the petitioner is a bona fide licensee of 315 Bore Rifle bearing S.B.B.L. No.

A/13 011298 vide Arms License No.

99 / 82 issued by District Magistrate, Bikaner, Rajasthan for all India [subject to local restriction] and the authority concerned to office of District Magistrate, East Champaran, Motihari is obliged to renew the said license of the petitioner by providing / issuing the Unique Identification

Patna High Court CWJC No.4507 of 2024(2) dt.16-05-2024 2/3 Number because earlier renewal of the said arm was made regularly from the District Authority of East Champaran and further direction be issued to the concerned authority with regard to renewal of his said arms license by providing/issuing Unique Identification Number concerned to said arms license and the Rifle as concerned.

ii. To hold and declare that the petitioner has no fault in approaching the appropriate authority for renewal of the said arms license and hence he is not liable for payment of any fine due to delay in renewal of said arms license and further the concerned authority be directed to not incur any penalty or fine regarding renewal of the said arms license."

At the outset, the learned counsel for the petitioner seeks a direction upon the District Magistrate, East Champaran at Motihari to consider the application filed by the petitioner for renewal of his arms license and issuance of Unique Identification Number, expeditiously.

Per contra, the learned counsel for the respondent-State submits that in case the

Patna High Court CWJC No.4507 of 2024(2) dt.16-05-2024 3/3 aforesaid application is still pending, the same would definitely be disposed off within a stipulated time frame, as is fixed by this Court.

Having regard to the limited prayer made by the petitioner in the present writ petition, I deem it fit and proper to direct the District Magistrate, East Champaran at Motihari to consider the aforesaid application of the petitioner, in case the same has been filed and is still pending consideration and dispose off the same, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
