2. The petitioner seeks bail in connection with Pipra P.S. Case No. 171 of 2022 dated 03.06.2022 registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and 25(1-B)a/26/35 of the Arms Act.

3. The prosecution case, in short, is that one country made pistol and two live cartridges was recovered from the possession of Saheb Giri. He is one of the members of the miscreants group apprehended by the police during the raid conducted by the informant and other police personnel.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

It is submitted that Santosh Kumar one of the co-accused has been granted bail vide Criminal Miscellaneous No. 69332 of 2022 dated 28.02.2023 by a Co-ordinate Bench of this Court. The petitioner is in custody since 04.06.2022, having one criminal case and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Pipra P.S. Case No. 171 of 2022.
