Heard learned counsel for the petitioner and learned counsel for the Vigilance.
The petitioner seeks regular bail in connection with Birpur P.S. Case No. 101 of 2018 lodged under Sections 467, 468, 471, 420, 120 (B)/34 of Indian Penal Code. As per the prosecution case, the allegation against the petitioner is to obtain employment as Panchayat Teacher on the basis of forge and fabricated documents.
Learned counsel for the petitioner submits that petitioner is now no more in the employment and ready to cooperate with the trial. She is in custody since 25.02.2022,
Patna High Court CR. MISC. No.19375 of 2022(4) dt.31-08-2022 2/3 chargesheet has already been filed in this case and petitioner having clean antecedent.
Learned counsel for the Vigilance opposes the prayer for bail and submits that she may be released as like that of other persons who have been released by the Court, but a condition is necessary to be imposed upon her so that the petitioner shall co-operate in the trial.
Considering the facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Begusarai in connection with Birpur P.S. Case No. 101 of 2018, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions: A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall resulted into cancellation of his bail bond.
B. One of the bailor shall be close relative who shall file affidavit before the court about his relation with the
