JUSTICE ARUN KUMAR ORAL ORDER 12-12-2017 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Narayanpur P.S.Case No. 19 of 2016 registered under Sections 302 and 201/34 of the Indian penal Code. Allegation in brief is that accused persons called the informant along with her husband and son and they picked up quarrel and Murlidhar Ojha and his son Bade Ojha caught hold informant's son and Hareshwar OJha gave a spade blow over him causing his death.
Learned counsel for the petitioners submits that there is some dispute with regard to settlement of land and there is no any specific overt act of assault against these two petitioners rather it is against one Hareshwar Ojha and similarly situated another coaccused Murlidhar Ojha has been admitted to bail by a co-ordinate
Patna High Court Cr.Misc. No.57849 of 2017 (2) dt.12-12-2017 2/2 Bench of this Court vide order dated 25.04.2017 passed in Cr. Misc. No. 16535 of 2015 and petitioners have clean antecedents. Having considered the aforesaid facts and circumstances, the petitioners, namely, Dhanjee Ojha @ Dhananjay Ojha and Bade Ojha @ Ramanuj Ojha @ Ramanuj are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-13th, Bhojpur, Ara in connection with Narayanpur P.S. Case No. 19 of 2016.
