JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Bhagwanpur Hat P.S. Case No. 248 of 2014, disclosing offences under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

Land dispute between the parties appears to be the reason behind the occurrence, leading into institution of the case. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and the injuries sustained are found to be simple in nature.

Patna High Court Cr.Misc. No.31890 of 2015 (2) dt.12-08-2015 2/2 Keeping in view that the petitioner has got no criminal antecedent and it is undertaken on his behalf that he will be cooperating in course of investigation and present himself before the Court, as and when required, I allow this application. This application for anticipatory bail is, accordingly, allowed. Let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M.K. Srivastwa, learned Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No. 248 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
