Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 363, 366, 376, 511, 504 and 506/34 of the Indian Penal Code, registered in connection with Kudhani P.S.Case No. 360 of 2021.

As per allegation, the petitioners enticed away the daughter of the informant along with co-accused persons. The petitioners did not obey the verdict of Panchayati.

No.21933 of 2022(2) dt.29-09-2022 2/3 The learned counsel for the petitioners has submitted that prior to lodging of this case, father of petitioner no.1 Arun Das had lodged a case against the members of the prosecution side which is Kudhani P.S.Case No. 357 of 2021. As a matter of fact, the members of the prosecution side badly assaulted petitioner no.1 merely because he was in love and affection with the daughter of the informant. He has submitted further that both the parties have compromised in the present case as well as in the counter case and the petitioners are the persons of clean antecedent.

Since the petitioners are students and they are the persons of clean antecedent, considering the facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM 1st (West) Muzaffarpur in connection with Kudhani P.S.Case No. 360 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided
