JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-11-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). To allow the petitioner to operate Saving Joint Account bearing no. 10636335066, existing at State Bank of India, Patliputra Branch, on the ground of missing of her husband Rajnish Kumar since 11.05.2010, who is traceless since more than 9 years, as per the provision contained under Section 22, 1 of the Master Circular of R.B.S. and Section 107 of the Indian Evidence Act, 1872, inasmuch as the petitioner has submitted

Patna High Court CWJC No.6979 of 2020(3) dt.13-11-2024 2/2 indemnity bond.

(ii) To consider the report of Officer-in-Charge of Digha Police Station, who has submitted a certificate that the said Rajnish Kumar is not being traced out and is missing since 13.05.2010, for which a U.D. Case No. 357 has been registered at Digha Police Station."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
