1. The present writ petition has been filed seeking the following relief(s):- "1. That this is an application for issuance of an appropriate writ and/or order and/ or direction commanding the respondents to bring uniformity in fixation of pay and pension amongst the employees who are equal in all respect i.e. date of joining, equal pay under 7th pay revision w.e.f. 01.01.2016 i.c. Rs.

76,200/-, date of retirement etc. and holding the same post on the date of retirement.

Patna High Court CWJC No.5531 of 2024(2) dt.25-04-2024 2/3 The petitioner also seeks direction to respondents to rectify the fixation of pension amongst the employees of same department i.e. Water Resources Department as there is a disparity in fixation of pay and pension.

The petitioner is getting less pension due to the wrong fixation with respect to others.

The petitioner's pension has been fixed less than other similarly situated employees who retired on same date as that of petitioner i.e. 31.12.2022.

In alternative to the above, the respondents be directed to dispose of the application filed by the petitioner on 26.09.2022 after holding an enquiry in the matter."

2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Additional Chief Secretary, Water Resources Department, Government of Bihar, Patna, for redressal of his aforesaid grievances. Liberty so sought is granted.

3. It is needless to state that in case appropriate petition is filed, by the petitioner, before the Additional Chief Secretary, Water Resources Department, Government of Bihar,

Patna High Court CWJC No.5531 of 2024(2) dt.25-04-2024 3/3 Patna, within a period of two weeks from today, the same shall be considered, in accordance with law and a reasoned and a speaking order shall be passed, thereon, within a period of six weeks, thereafter.

4. The present writ petition stands disposed off on the aforesaid terms.
