For commanding the respondents to forthwith pay the petitioner, arrears of house rent allowance and transport allowance in view of Finance Department (Establishment Section) office order no. 168 dated 20.12.2010 and further to pay interest at the rate of 18% per annum on gratuity which was paid to the petitioner after much delay on 13.12.01 (almost 4 years) after the date of retirement of the petitioner.

Learned counsel for the petitioner, under instruction, states that, with the passage of time, some of the prayers have become infructuous. As such, petitioner may be permitted to withdraw the present petition, reserving liberty to approach respondent No. 2, namely The Principal Secretary, Department of Finance, Govt. of Bihar, Patna, for the remaining grievances.

Prayer allowed.

Petition is disposed of as withdrawn with the liberty aforesaid.
