The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 82.50 litres of Nepali Soufi Wine was recovered from the two jute bags kept on a motorcycle which was being boarded by the petitioners. It is urged that the petitioners have remained in custody since 02.09.2017, i.e., for about more than two and

Patna High Court Cr.Misc. No.56185 of 2017(2) dt.23-11-2017 2/2 half months. It is claimed that the petitioners are having clean antecedent.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with G.O. Case No. 288 of 2017 with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
