JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is a person of clean antecedents and is in custody since 07.02.2020, seeks bail in connection with Excise Case No. 766 of 2019 arising out of Durgawati P. S. Case No. 285 of 2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. It appears that on secret information that liquor is being transported by a truck, which was led by a motor-cycle being driven by two persons, the vehicles were spotted. The aforesaid two persons left the motorcycle and fled away. From the motor-cycle, there has been recovery of liquor.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge (Excise) Kaimur at Bhabhua in connection with Excise Case No. 766 of 2019 arising out of Durgawati P. S. Case No. 285 of 2019.
