Petitioners apprehend their arrest in Complaint Case No.895 of 2015, for the offences allegedly committed by the petitioners under Sections 147, 354, 379, 447, 452, 504 and 34 of the Indian Penal Code.

The complainant made allegation that the petitioners and others entered into his house, tried to outrage the modesty of his wife and assaulted the complainant and others. Learned counsel for the petitioners submits that the petitioners are next door neighbours of the complainant. Earlier father of the complainant also lodged Complaint Case No.494 of

Patna High Court CR. MISC. No.22257 of 2019(2) dt.11-04-2019 2/2 2014 under Sections 380, 427 and other sections of the Indian Penal Code. On account of dispute with regard to construction of boundary, the complainant and his father lodged the case implicating the petitioners.

Taking into consideration the facts and nature of allegations made against the petitioners and the fact that it appears that prior to institution of the present complaint case, Narendra Pandey, the father of the complainant, filed Complaint Case No.494 of 2014 against Diwakar Pandey and others including Ram Sharan Mahto, petitioner no.2, Sanjay Mahto, petitioner no.1, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No.895 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
