JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Gajendra Kumar Singh, learned counsel for the petitioner and Sri Nityanand, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 27-07-2017 in Basantpur P.S. Case No. 251 of 2017 registered for offence under Sections 272, 273, 308 of the Indian Penal Code and Sections 35(A)(B), 36 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
At the very outset, learned counsel for the petitioner has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. Besides this, it has been argued that save and except confessional statement of co-accused, there is no other material to connect the petitioner in the present case. The submission made by learned counsel for the petitioner was not disputed by

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Dilip Sah @ Dilip Kumar Sah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge , Siwan in connection with Basantpur P.S. Case No. 251 of 2017.
