The petitioner seeks bail in connection with Pakaridayal P.S. Case No.121 of 2016 registered under Sections 147, 148, 149, 302, 307 and 120-B of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Additional Chief Judicial Magistrate, Motihari, East Champaran. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the specific allegation to make indiscriminate firing through sophisticated firearm has been made against the co-accused Rakesh Singh. There is allegation against the rest accused including the petitioner

Patna High Court Cr.Misc. No.57055 of 2017 (2) dt.10-01-2018 2/2 to make firing through Nalkatua. The petitioner is in custody since 29.08.2016.

Admittedly, the prayer of the petitioner for grant of bail was earlier rejected by this Court vide order dated 22.03.2017 passed in Criminal Misc. No.52918 of 2016 on merit. I find no fresh ground to reconsider the prayer of the petitioner for grant of bail. Accordingly, the prayer of the petitioner for grant of bail is again rejected.
