2. The petitioner has preferred this application for grant of regular bail in connection with Piprahi P.S. Case No. 122 of 2024 dated 28.08.2024 registered for the offences punishable under Section 103 of the B.N.S.

3. As per the prosecution case, on 28.08.2024 at about 6:30 PM, the informant and her husband were sitting at their home, in the meantime, her son came there and started abusing and assaulting them on some issue. It is further alleged that the petitioner pushed his father and started assaulting him with legs, fists and a brick on his chest. The petitioner also assaulted the informant and her daughter. Thereafter, the informant brought

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that during partition a hot discussion was made between the petitioner and his father and then he died due to heart attack. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.09.2024.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the specific allegation of assaulting his father with a brick on his chest is against the petitioner due to which he succumbed to his injury which is also evident at para-3 of the case diary. As per para nos. 16 and 17 of the case diary, the witnesses of this case have supported the prosecution case.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Piprahi P.S. Case No. 122 of 2024, pending in the Court of

7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
