The petitioner seeks bail in connection with K. Hat P.S. Case No. 568 of 2017 dated 14.08.2017 instituted for the offences 272, 273, 413, 414 of the Indian Penal Code and Section 37(A) of the Bihar Prohibition and Excise Act, 2016 read with Section 25(1-b) a, 26, 35 of the Arms Act.

It has been alleged in the F.I.R that on the arrival of the police party, the accused persons made an attempt to flee away. Later, one Raja @ Prince was apprehended with a country made pistol and cartridges whereas, from a room belonging to the petitioner and others, about thirty litres of liquor was recovered.

The petitioner is in custody since 15.08.2017

Patna High Court Cr.Misc. No.55659 of 2017 (2) dt.05-12-2017 2/2 and apart from the present case, he has been made accused in another case of similar nature in the past.

Regard being had to the period of custody of the petitioner, this Court is inclined to grant bail to the petitioner. The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Additional District Judge-III-cum-Special Judge, Excise, Purnea in connection with K. Hat P.S. Case No. 568 of 2017.
