Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. The petitioner is in custody since 01.04.2017 as stolen motorcycle was, allegedly, recovered from the house of the petitioner.

Submission is that similarly situated co-accused, namely, Birendra Kumar @ Birendra Prasad @ Chotu Prasad @ Chhotu has been granted regular bail by a Coordinate Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 41019 of 2017 vide Annexure-2 and other co-accused, namely, Upendra Ram @ Sukha has been granted bail by the learned court below vide order dated 07.06.2017 passed in B.P. No. 225 of

Patna High Court Cr.Misc. No.58410 of 2017 (2) dt.12-12-2017 2/2 2017.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chandi Police Station Case No. 88 of 2017, subject to the condition that both the bailors shall be resident of the territorial jurisdiction of the court below having immovable property and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
