The petitioner apprehends his arrest in connection with Bithan P.S. Case No. 96 of 2021 dated 04.07.2021 for the offences punishable under Section 20, 22 of the N.D.P.S. Act. Earlier vide order dated 14.09.2022 passed in Cr. Misc. No. 31765 of 2022 with an analogous case, the prayer for anticipatory bail of the petitioner was dismissed as withdrawn on the request of learned counsel for the petitioner with a liberty to the petitioner to surrender before the learned court below and seek regular bail.

When the case was taken up for hearing, once again, after some arguments, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application.

Patna High Court CR. MISC. No.22496 of 2023(2) dt.12-04-2023 2/2 Permission is granted.

Accordingly, this anticipatory bail application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced by this order taking into consideration Annexures 3, 4 and 5 filed in the instant application.
