JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.
This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and 4 of the Dowry Prohibition Act.
Petitioner is the husband of the complainant Resham Devi.
Learned counsel for the petitioner has submitted that the petitioner is ready to keep the complainant, his wife
with full love and dignity. He has further submitted that the complainant had earlier instituted a matrimonial suit seeking divorce which resulted into compromise between the parties. However, in view of the subsequent dispute between them, the present complaint case came to be instituted.
He has further submitted that the petitioner will also pay to the complainant the maintenance amount which has been ordered to be paid to her by the Court of Principal Judge, Family Court, Munger within two months from today.
Learned counsel appearing on behalf of the complainant has taken a very fair stand and has submitted that the Opposite party shall try to restore the relationship with the help of the petitioner. If any untoward situation arises in the meanwhile, it would be open to the Opposite party no.2 to take appropriate action, before appropriate forum.
In view of submission as noted above, let petitioner above named in the event of his arrest/surrender within
fifteen days after 2nd June, 2015 in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub divisional Judicial Magistrate, Sadar Munger in complaint case No. 1148C of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P. C.
Till 2nd June, 2015 no steps shall be taken to take the petitioner in custody.
