Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with P.S. Harnaut (Chero O.P.) Case No. 55/2019 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 30 liters of desi wine was seized.

Learned counsel submits that petitioner is in

Patna High Court CR. MISC. No.18874 of 2019(2) dt.28-03-2019 2/2 custody since 13.2.2019.

He submits that nothing was recovered from the possession of the petitioner.

Considering the fact that petitioner has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-3 cum Special Judge Excise Act, Nalanda at Biharsharif, in connection with P.S. Harnaut (Chero O.P.) Case No. 55 of 2019.
