The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code. It is alleged that the accused persons including the petitioner came and made assault to the informant. The specific accusation of assault is against Md. Kurshid on the head of the informant when petitioner no. 1 Md. Nazir assaulted with the bamboo stick and Md. Zubair with rod.

It is submitted by Learned counsel for the petitioners that only one injury of simple nature has been found caused by

Patna High Court Cr.Misc. No.31526 of 2015 (2) dt.03-08-2015 2/2 hard and blunt substance and the accusation has been levelled in the background of land dispute as the petitioners are cousin of the informant.

A statement made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Kurhni P.S. Case No. 165 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
