The petitioner is in custody in connection with Barauni Rail P.S. Case No. 05 of 2020 for the offence under Section 414 of the Indian Penal Code and Section 137/147 of the Indian Railway Act.

Learned counsel appearing on behalf of the petitioner would submit that except for the criminal antecedents, there is no material to connect the petitioner with the alleged crime. The petitioner is in custody since 09.01.2020. Learned counsel for the petitioner submits that Aadhar card and ATM card which were recovered from the possession of the petitioner belong to him.

Patna High Court CR. MISC. No.17529 of 2020(2) dt.02-06-2020 2/2 Considering the facts and circumstances of the case, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 05 of 2020, subject to the condition that on release, the petitioner shall render his services as volunteer in the District Health Centre for a period of three months in dedicated Covid hospital. He is required to report the District Nodal Officer in the concerned region who shall utilise the service of the petitioner appropriately.
