ANJANA MISHRA ORAL ORDER 25-03-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Bagaha (Patkhaulia) P.S.Case No. 38 of 2014 for the offences punishable under Sections 419, 420 and 170 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR. He further submits that several rent receipts and documents are said to have been recovered from the possession of two persons having issued in the name of different persons. It is further submitted that when the petitioner was going with the receipt, his motor cycle was punctured and subsequently stolen/lost. It is further submitted that the petitioner is a Halka Karamchari in the block office situated at Baagaha-2.Learned counsel for

Patna High Court Cr.Misc. No.39999 of 2014 (2) dt.25-03-2015 2/2 the petitioner further submits that none of the rent receipts issued is said to have been issued by him and therefore no criminal liability can be attached on him.

Considering the aforesaid submissions and also the fact that the petitioner is a government service, let the petitioner, named above, in the event of his arrest/ surrender in the court below within two weeks from the date of receipt/ production of a copy of this order be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bagaha (West Champaran) in connection with Bagaha ( Patkhaulia) P.S.Case No. 38 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
