JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 This is an application for grant of anticipatory bail in connection with Maner P.S. Case No. 680 of 2018, disclosing offences under Sections 406, 409, 420, 34 of the Indian Penal Code.

Allegation against the petitioner is that who happens to be the Clerk in the office of Indira Aawas Yojna and that he has granted Indira Aawas Yojna to a fake person and also he has not given remaining amount.

Submission of the learned counsel for the petitioner is that the selection of beneficiaries of Indira Aawas Yojna is under the control of Block Development Officer who is to select the beneficiaries, which is sent to the Collector and as such, he is not responsible for that. Further petitioner was not posted at that time.

Patna High Court CR. MISC. No.21430 of 2019(3) dt.21-06-2019 2/2 Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for bail on the ground that during the inquiry, petitioner was found responsible for that.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of leaned Additional District and Sessions Judge-II, Danapur, in connection with Maner P.S. Case No. 680 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
