The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that the petitioner and other accused persons came at the door of the informant and made indiscriminate firing and thereby caused injury on the abdomen of father of the informant, who subsequently succumbed to the injuries.

It is submitted by learned counsel for the petitioner that the accusation is not specific and during trial of the coaccused out of eight charge-sheeted witnesses six have not supported the accusation and have been declared hostile. The aforesaid facts may constitute good ground for

Patna High Court Cr.Misc. No.32461 of 2015 (2) dt.10-08-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Noor Sarai P.S. Case No.119 of 2014, pending before the learned Chief Judicial Magistrate, Nalanda at Bihar Sharif.

With the above observation, this application is, accordingly, disposed off.
