JUSTICE SHIVAJI PANDEY ORAL ORDER 17-02-2021 Heard learned counsel for the petitioner and learned counsel for the Economic Offences Unit, Bihar. In this case, the petitioner is seeking regular bail in connection with Special Case No. 31A of 2014, arising out of Economic Offence P.S. Case No. 21 of 2014, registered for the offence under Sections 20(b) (i), 23 and 29 of the N.D.P.S. Act. Allegation has been made that on secret information a team was constituted, which intercepted the truck and from the said truck about 5 quintal 37 kg. 250 grams of ganja has been recovered. It has been alleged that at the relevant time, petitioner was in Tihar Jail in connection with other N.D.P.S. case.

Learned counsel for the Economic Offences Unit submits that in that case the Trial Court has convicted the

In turn, learned counsel for the petitioner submits that at the stage of appeal, there is likelihood of grant bail but, the same could not be materialized on account of this case. Looking to the entirety of the facts and circumstances of the case as also the earlier activity of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to expedite the trial and conclude the same within a period of one year from the date of receipt / production of a copy of this order.
