This is an application seeking some modification and extension of time to avail the privilege granted to the petitioner vide order dated 05.08.2014 passed in Cr. Misc. No. 16290 of 2014, in connection with Pasraha P.S. Case No.106 of 2013, pending before the Chief Judicial Magistrate, Khagaria apart from other on the statement that he carries no criminal antecedent but in fact there is another case being Pasraha P.S. Case No.96 of 2013 against the petitioner which according to him was not known.

Taking into consideration, learned counsel for the petitioner is permitted to make necessary correction in paragraph 3 of the original application positively by Monday i.e. 12th January 2015 and, thereafter, in fourth paragraph of the order dated 5th August 2014 passed in Cr. Misc. No. 16290 of 2014 after the words "who carries no criminal antecedent" the word "except Pasraha P.S. Case No.96 of 2013, wherein he is on bail" be

Patna High Court Cr.Misc. No.50282 of 2014 (2) dt.09-01-2015 2/2 treated inserted.

Further, subject to deposit of Rs. 8,000/- (Rs. Eight Thousand) with District Legal Services Authority, Khagaria, the period to avail the liberty granted to the petitioner vide order aforementioned is extended till 23rd January 2015.
