The petitioner seeks regular bail in connection with Phulparas PS case no. 174 of 2018 registered for the offence punishable under Section 302 of Indian Penal Code. The allegation is regarding the father of the informant having been found dead in the morning and his clothes were strained with blood and there was a cut mark on the neck of the father of the informant.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case merely on the disclosure made by the co-accused person namely Md. Saddam who was arrested by the police. It is further

Patna High Court CR. MISC. No.19059 of 2019(2) dt.04-04-2019 2/2 submitted that charge-sheet has been filed against the said co-accused Md. Saddam and one another co-accused person namely Anil Mahato, however subsequently, charge sheet has been submitted by the police against the petitioner herein. It is further submitted that there is no material available on record to connect the petitioner with the alleged crime save and except suspicion on the basis of confessional statement of the co-accused namely Md. Saddam. The petitioner is said to be having clean antecedent and he is languishing in custody since 18.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II Jhanjharpur (Madhubani) in connection with Phulparas PS case no. 174 of 2018.
