Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420, 406, 409, 120(B)/34 of the Indian Penal Code.

Informant, who is a widow, has alleged in her written complaint that she wanted to construct her house after purchasing land and in this respect accused Ashutosh Kumar introduced himself as an agent of A B Data Infotech Private Limited and it is further alleged that on the assurance given by Ashutosh Kumar that he will arrange land for her, she deposited rupees four lacs in the bank account as well as rupees three lacs in the personal account of said Ashutosh Kumar and, thereafter, neither her money was refunded nor any land was registered in

Patna High Court CR. MISC. No.29097 of 2021(2) dt.21-10-2021 2/2 her name.

It is submitted on behalf of learned counsel for the petitioner that nothing specific has been alleged against the petitioner in the written complaint and it is further submitted that in the anticipatory bail petition filed by Abhinav Vivek in the court below, one of the directors of the company, has admitted before the court below to refund the amount given by the informant, as contained in Annexure 2 series. Petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Ara Town P.S. Case No.420/2020 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
