JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Jamui P.S. Case No. 97 of 2015 for the offence under Sections 363/34 of the Indian Penal Code. Heard learned counsel for the petitioners and the State.
The prosecution story, in brief, that petitioners came to the house of informant and took his son on Motorcycle saying that they have to go to repairing mobile. When his son did not return till evening then informant started to search his son but did not found, then it was suspected that all three persons kidnapped his son and might have murdered. It is submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. From perusal of
Patna High Court Cr.Misc. No.30648 of 2015 (2) dt.30-07-2015 164 Cr.P.C. statement of the victim, it is evident that a forceful marriage of the victim has been performed in which the petitioners and others have participated. Further, it is submitted that the marriage is admitted and the victim has already recovered after the marriage.
On behalf of the State, it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 97 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Sudhir Singh, J) P.K./- U T
