Earlier the prayer for bail of the petitioner has been rejected on merit, vide order dated 18.7.2017 passed in Cr.Misc.No.29264 of 2017.

A report was called for from the learned A.C.J.M. IV, Buxar and from perusal of the status report of the case, it appears that the charge has been framed.

It is submitted on behalf of the petitioner that his prayer for bail was rejected as earlier few facts could not be brought to the notice of the court and now he is in custody for seven months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.57468 of 2017 (4) dt.13-12-2017 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since he is in custody for seven months and the charge has also been framed, the learned trial court is directed to expedite the trial and try to conclude it within a period of seven months.

At the same time, the S.P., Buxar is directed to see that the witnesses are produced in the court concerned on the date fixed so that it may be concluded within the period as specified. With the aforesaid observation, the application is dismissed.
