In this case, the petitioner is apprehending his arrest in connection with Rahui P.S. Case No. 10 of 2019 registered for offences under sections 406, 409, 420, 467, 468, 471, 477/34 of the Indian Penal Code.

From the F.I.R., it appears that the land was standing in the name of one Shyama Devi but, the money was transferred in the name of Anita Devi whereas the Land Possession Certificate was granted in favour of both of them. Later on, a plea was taken that the Land Possession Certificate was given on account of the fact that Shyama Devi was found dead but, during enquiry, it transpired that Shyama Devi was alive. When the compensation money has come to the account of Anita Devi, she transferred Rs. 10 lacs in the account of the present petitioner.

Learned counsel for the petitioner submits that as and

No.17362 of 2019(2) dt.26-03-2019 2/2 when he know about credit of an amount of Rs. 10 lacs in his account, he immediately wrote a letter to the Bank Manager for debiting of the said amount from his account. He further submits that the petitioner has no role or connection with either Shyama Devi or Anita Devi.

Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Rahui P.S. Case No. 10 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
