The petitioner apprehending his arrest in connection with Town P.S. Case No. 422 of 2014 instituted under section 420/34 has filed the present application seeking anticipatory bail. According to the FIR one Anjani Singh took a sum of Rs. 4,00,000/- from the informant for establishing a business. The business failed. On demand Anjani Singh issued two cheques which bounced. So far as the petitioner is concerned the allegation is that Anjani Singh had started a business in which the petitioner was one of the parties. The contention of the petitioner is that the allegation of cheating, if any, is attributed to Anjani Singh who is
Patna High Court Cr.Misc. No.35593 of 2014 (2) dt.11-02-2015 2 / 2 said to have received money from the informant and thereafter issued two cheques which were dishonored. The petitioner has no criminal antecedents.
In the circumstances, in the event of arrest/surrender within four weeks from today the petitioner above named shall be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No. 422 of 2014 subject to condition as laid down under section 438(2) Cr. P.C. with one of the bailors being own/close family member of the petitioner.
