Petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and 25(1-B)a, 26 and 35 of the Arms Act.
The petitioner is in custody since 03.10.2016 with allegation that a loaded pistol and live cartridge were recovered from his possession and with further allegation that the petitioner and others were preparing to commit dacoity. This Court had earlier refused prayer for bail on 21.03.2017 in
Patna High Court Cr.Misc. No.55201 of 2017 (2) dt.22-11-2017 Cr.Misc.No. 8596/2017 with liberty to renew the prayer, if the trial is not concluded within six months. The trial has not been concluded, hence considering the period of custody undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Session Trial No.97 of 2017 arising out of Samastipur Muffasil Police Station Case No. 301 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
