JUSTICE GOPAL PRASAD ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Complaint Case No.156/14 for the offence under Sections 498(A), 406 of the I.P.C. and 3⁄4 of the D.P. Act.
There is allegation of demand of dowry from the victim lady by the petitioner whose marriage was solemnized four years earlier.
Hence, having regard to the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today,
Patna High Court Cr.Misc. No.39116 of 2014 (2) dt.04-03-2015 2/2 be released on provision bail for a period of three months on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan, in Complaint Case No.156/14 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that either he will keep the victim with him as wife with full dignity and honour or he will give maintenance worth Rs.1500/- per month in case the complainant does not live with him thereafter the trial court shall confirm his bail bond after four months on compliance of the aforesaid conditions, failing which the trial court shall cancel his bail bond.
