Petitioner, already in custody, seeks bail in connection with Kahalgaon (Shivnarayanpur) P.S.Case No. 128 of 2017, registered under Sections 302/34 of the Indian Penal Code. The allegation in brief is that the dead body of the informant's son was found in a field after killing him. The F.I.R. was lodged against unknown.

Learned counsel for the petitioner submits that no incriminating article was transpired against the petitioner and stated that he along with the deceased and on the basis of confessional of statement of two co-accused persons namely, Diwar Kumar and Ranjit Kumar Yadav regarding their

No.54718 of 2017 (4) dt.02-02-2018 2/2 involvement in the offence of murder, there is no any other material available against the petitioner and the charge sheet has been submitted against the petitioner. It is also submitted that the petitioner has no criminal antecedent and he is in custody since 25.04.2017.

Having considered the said facts and circumstances, the petitioner, Pankaj Yadav, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- IVth , Bhagalpur in connection with Kahalgaon (Shivnaraynpur) P. S. Case No. 128 of 2017 .
