Petitioner apprehends arrest in connection with Kadam Kuan P.S. Case No. 256 of 2018 registered for the offence punishable under sections 30(a), 37(a)(b)(c), 38(1) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. He has no connection with the alleged occurrence as also other co-accused persons. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

No.54123 of 2018(2) dt.12-09-2018 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Kadam Kuan P.S. Case No. 256 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
