JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-06-2020 Heard Mr. Dhananjay Kumar Pandey, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Dhankund P.S. Case No. 87 of 2019, dated 24.07.2019, instituted for the offences under Sections 304/34 of the Indian Penal Code.

The petitioner is a person of clean antecedents and is in custody since 05.02.2020.

It appears that the son of the informant, aged about 17 years, got electrocuted because of live electric wire which was left exposed by the petitioner and others for

Patna High Court CR. MISC. No.16700 of 2020(2) dt.03-06-2020 2/2 illegally extracting electrical energy and consuming the same in their houses.

It has been submitted on behalf of the petitioner that his father is a valid consumer of electricity and pays electric bill regularly. The deceased may have been electrocuted at some other place, but the petitioner has been unnecessarily made accused in this case.

Considering the nature of accusation against the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhankund P.S. Case No. 87 of 2019. The application stands allowed.
