Petitioner seeks bail in Digha P.S. Case No. 179/2018, registered for the offences punishable under Section 399 and 402 of the Indian Penal Code and section 25(1-b)a and 26 of the Arms Act.

It is alleged that on secret information that some miscreants have assembled to commit dacoity, the informant raided the place. On seeing police party, miscreants tried to flee away, but on chase three miscreants have been arrested who disclosed their names as Ravi Dome (petitioner), Arjun Ram, Mahesh Yadav. From possession of petitioner one loaded country made pistol, two live cartridges and one mobile phone were

recovered.

It has been submitted that petitioner has falsely been implicated in the case. Petitioner is in custody since 04.04.2018. Other co-accused have been granted bail by different co-ordinate benches of this court vide order dated 20.08.2018 passed in Cr. Misc. No. 49414/2018 and order dated 26.09.2018 passed in Cr. Misc. No. 51483/2018.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna in connection with Digha P.S. Case No. 179/2018, subject to the conditions:

(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his absence on two consecutive dates without proper and reasonable reason will be sufficient to cancel his bail bonds.

(3.) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
