2. The petitioner seeks regular bail in connection with Kharagpur P.S. Case No. 693/2023 lodged on 02.12.2023 under Sections 341, 323, 324, 325, 307, 452, 504, 506, 34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against nine named accused persons, including the present petitioner alleging therein that they all assaulted the informant upon his oppose to sell wine.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. For the alleged occurrence of 05.11.2023, the FIR has been lodged on 02.12.2023 with inordinate delay. For the said occurrence, the

Patna High Court CR. MISC. No.20854 of 2024(2) dt.02-04-2024 2/2 petitioner has also filed a complaint case. The petitioner is in custody since 12.01.2024 having no criminal antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be released on bail, but only after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IV, Munger, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
