Petitioner seeks bail in Khodawandpur P.S. Case No. 13 of 2018 registered for the offence punishable under Sections 419, 420, 231, 232, 489(A), 489(B), 489(C), 489(D), 489(E)/34 of the Indian Penal Code.

Informant has alleged in his fardbeyan that on 05.02.2018 a customer purchased metal and gave him note of Rs. 2000/-, however, subsequently he came to know that the note was fake and after search he found petitioner and caught him and produced him before the police and on motorcycle being searched by police four fake notes of Rs. 2000/- each and Rs. 15,000/- cash was seized from his dickey. A lady named Vandana Devi @ Chandani Devi was accompanying petitioner.

Patna High Court Cr.Misc. No.51465 of 2018(2) dt.27-08-2018 2/2 It has been submitted on behalf of the petitioner that he has committed no offence and has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner and the story of recovery of motorcycle and fake notes is concocted and has been planted only to implicate him in this case. The lady who was accompanying the petitioner has been granted bail by a co-ordinate bench of this Court vide order dated 09.07.2018 passed in Criminal Miscellaneous No. 38534 of 2018. Petitioner has got no criminal antecedent and is in custody since 06.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ADJ-II, Begusarai, in connection with Khodawandpur P.S.
