Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bodhagaya P.S. Case No. 112 of 2022 registered on 27.02.2022 lodged under Sections 413, 414 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that vide order dated 04.11.2022, passed in Cr. Misc. No. 36042 of 2022 in regular bail application of the petitioner was rejected. He submits that petitioner is in custody since 02.07.2022. Counsel further submits that Trial has commenced and prosecution witness is going on. He further submits that there is no chance

Learned counsel for the State opposes the prayer for bail.

A report has been called for in this case by which it transpires that out of nine prosecution witnesses, four have been examined, who have supported the prosecution version. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.

With this observation, the bail application stands rejected.

Trial court is directed to expedite the trial as early as possible.
