The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 307 of 2012 registered for offences punishable under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against eight persons including the petitioner of drowning the deceased, however, during the course of investigation the Dewar (brother-in-law) of the informant has stated that the deceased was driving motorcycle and had dashed with a tree which misdirected the course of the motorcycle and he went inside the ditch causing his death. It is contended that for reason the prosecution has submitted

Patna High Court Cr.Misc. No.39511 of 2014 (2) dt.13-03-2015 2/2 chargesheet under Section 304 of the Indian Penal Code. Having regard to the facts and circumstances of the case, let the petitioners, namely, Gautam Jha be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Runnisaidpur P.S. Case No. 307 of 2012, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
