ANJANA MISHRA ORAL ORDER 18-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners being full brothers apprehend their arrest in connection with a case registered for the offences punishable under Sections 147,148,149,341,323,307,253 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that though the allegation has been made that the petitioners participated in an occurrence at Harchanda Chowk within Kanti Police Station, the petitioners could not be actually present there as Tilak Ceremony of the petitioner No. 2 was to take place on the said date. He further submits that the petitioners have no criminal antecedent and they have been falsely implicated in this case on account of local politics.

No.32740 of 2015 (2) dt.18-08-2015 P2/2 Considering the facts and circumstances of the case and also the nature of allegation, let the petitioners abovenamed, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kanti (Panapur O.P.) P.S. Case No.226 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
