2. The petitioner seeks bail in connection with Sessions Trial No. 535 of 2022 arising out of Barhat P.S. Case No.28 of 2018 registered for the offence punishable under Sections 147, 148, 149, 302, 201 and 427 of the Indian Penal Code and Section 3⁄4 of Protection of Damage of Public Property Act and Section 27 of the Arms Act as well as Sections 9, 10, 13, 16, 18, 20, 21 of UAP Act.

3. As per FIR, the petitioner and the other named coaccused persons along with sixty one accused persons (naxal) holding lethal weapons are alleged to have caused death of Madan Koda and Pramod Koda by means of firearm injury.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.30016 of 2025(2) dt.09-05-2025 2/3 petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that petitioner was not involved in such occurrence and he had no information about the case. It is submitted that nothing surfaced during course of investigation against this petitioner, which may connect this petitioner with the present set of occurrence. It is also submitted that similarly situated other co-accused persons have already been granted bail by co-ordinate Benches of this Court in Cr. Misc. No. 52923 of 2024 and 25107 of 2024 vide orders dated 18.10.2024 and 10.04.2024, respectively It is further submitted that petitioner is in custody since 28.07.2021. He next submits that informant has made about sixty one accused persons in the FIR but it is very surprising that how the informant remembered the name of sixty one accused persons in the FIR.

5. Learned APP appearing for the State, opposes the prayer for bail of the petitioner.

6. Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Sessions Trial No. 535 of 2022 arising out of Barhat P.S. Case No.28 of 2018 on furnishing bail bonds of Rs.10,000/-
