Petitioner seeks bail in a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act. The petitioner is in custody since 13.09.2017 on allegation that more than 10 Kg of Ganja was allegedly recovered from his possession.

Learned counsel for the petitioner submits that the recovered quantity is not commercial quantity and the petitioner has disclosed his criminal antecedent in paragraph-3 of the bail petition, which is of other trivial criminal cases and not case under the N.D.P.S.Act.

Considering the entire facts and circumstances, I am

Patna High Court Cr.Misc. No.56948 of 2017 (3) dt.08-01-2018 not inclined to enlarge the petitioner on bail at present. Hence, prayer is refused. However, the petitioner may renew his prayer for bail after completion of nine months of custody, if the trial is not concluded within time.

Accordingly, the application is rejected in connection with N.D.P.S.Case No.19 of 2017 (arising out of Manjhi P.S.Case No.194 of 2017) pending before the court of learned Sessions Judge, Saran at Chapra.
