Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No. 682 of 2019, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

30 litres of country-made liquor is said to have been recovered from the shop of this petitioner.

It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner. Petitioner has no

Patna High Court CR. MISC. No.18059 of 2020(2) dt.09-07-2020 2/2 concern with the seized liquor. Petitioner has got no criminal antecedent.

Considering the facts aforesaid and the fact that shop belongs to this petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
